Online Store Terms and Conditions

Before using our online shop and services, please read these terms and conditions carefully.

1. General Provisions

By accessing and using this website, you accept and agree to be bound by the terms and conditions of this agreement.

2. The Regulations specify the rules for using the online shop “indux5” hereinafter referred to as the “Shop” available at “www.indux5.com”.

3. The owner and operator of the website “www.indux5.com” is:

4. The Regulations are made available to the user free of charge before the conclusion of an electronic service contract.

5. These Regulations are the regulations referred to in Article 8 of the Act on the Provision of Services by Electronic Means.

6. These Regulations specify, in particular:

a) the rules for registering and using an account within the online shop;

b) the terms and conditions for making electronic reservations for products available within the online shop;

c) terms and conditions for submitting Orders electronically within the online shop;

d) principles for concluding Sale Agreements using the services provided within the Online Shop.

7. Use of the online shop is possible provided that the teleinformatic system used by the Customer meets the following minimum technical requirements:

(1) A computer or laptop with Internet access; (2) Access to email; (3) A web browser: Mozilla Firefox version 47.0 or higher (stable) or Internet Explorer version 11.0 or higher (stable), Opera version 38.0 or higher (stable), Google Chrome version 49.0 or higher (stable), Safari version 9.0 or higher (stable); (4) Enabling Cookies and JavaScript support in the web browser; (5) Access to a mobile phone capable of receiving SMS messages.

8. To use the online shop, the Customer must independently obtain access to a computer workstation or terminal device with Internet access.

9. In accordance with applicable law, ProAdept reserves the right to restrict the provision of services through the Online Shop to individuals under the age of 18. In such a case, potential Customers will be notified of the above.

10. Customers can access these Terms and Conditions at any time via a link placed on the homepage of the www.indux5.com website and can download and print them.

11. The information about the Goods provided on the Online Shop's websites, in particular their descriptions, technical and utility parameters, and prices, constitutes an invitation to conclude a contract within the meaning of Article 71 of the Civil Code.

2. Definitions

The terms used in the Regulations mean:

1. Customer – a natural person, a legal person or an organisational unit without legal personality, which is granted legal capacity by special provisions, who places an Order within the Shop;

2. Civil Code – Act of 23 April 1964 (Journal of Laws No. 16, item 93, as amended);

3. Terms and Conditions – these Terms and Conditions for the provision of electronic services within the online shop “indux5”

4. Online Shop (Shop) – a website available at “www.indux5.com” through which the Customer can, in particular, place Orders;

5. Service – services offered in the Online Shop;

6. Sale Agreement – a sale agreement for Goods within the meaning of the Civil Code, concluded between ProAdept and the Customer, entered into using the Store's internet service;

7. Act on specific conditions of consumer sales – Act of 27 July 2002 on specific conditions of consumer sales and on amendment of the Civil Code (Journal of Laws No. 141, item 1176 as amended);

8. Act on the Provision of Services by Electronic Means – Act of 18 July 2002 on the Provision of Services by Electronic Means (Journal of Laws No. 144, item 1204, as amended);

9. Order – a declaration of will by the Customer, aimed directly at concluding a Sales Agreement, specifying in particular the type and quantity of Goods.

3. Terms of Use for the Online Shop

1. The condition for commencing use of the Online Shop is registration within it.

2. Registration is carried out by completing and accepting the registration form, made available on one of the Shop's pages.

3. Registration requires agreeing to the terms of the Regulations and providing personal data marked as mandatory.

4. ProAdept may deprive the Customer of the right to use the Online Shop, as well as may restrict their access to part or all of the resources of the Online Shop, with immediate effect, in the event of the Customer's breach of these Terms and Conditions, and in particular when the Customer:

a) provided false, inaccurate, or outdated information during registration in the online shop, which was misleading or infringed the rights of third parties,

b) through the online store, has infringed the personal rights of third parties, in particular the personal rights of other online store customers,

c) engages in other conduct that ProAdept deems to be in breach of applicable laws or general principles of internet use, or to be detrimental to the good name of ProAdept and/or the website “www.indux5.com”.

A person who has been banned from using the online shop cannot re-register without the prior consent of ProAdept.

6. To ensure the security of message and data transmission in connection with the services provided within the Website, the Online Shop takes technical and organisational measures appropriate to the level of security risk of the services provided, in particular measures to prevent unauthorised persons from obtaining and modifying personal data transmitted over the Internet.

7. The client is obliged in particular to:

a) not delivering or transferring content prohibited by law, e.g. content promoting violence, defamatory content, or content infringing on personal rights and other third-party rights,

b) using the Online Shop in a manner that does not disrupt its functioning, in particular through the use of specific software or devices,

c) not taking actions such as: sending or posting unsolicited commercial information (spam) within the Online Shop,

d) using the Online Shop in a manner that is not burdensome to other customers and to ProAdept.

e) using any content posted on the Online Shop solely for your own personal use,

f) using the Online Shop in a manner consistent with the provisions of the law in force in the territory of the Republic of Poland, the provisions of these Regulations, as well as the general principles of using the Internet.

4. Procedure for concluding the Sale Agreement

1. To conclude the Sale Agreement through the Online Shop, you must go to the website “www.indux5.com”, select the Service, and take subsequent technical steps based on the messages displayed to the Customer and the information available on the website.

2. The Customer's choice of ordered Services is made by adding them to the cart.

3. While placing an Order – up to the moment of pressing the „I order” button – the Customer has the option to modify the entered data and the scope of the selected Service. To do this, follow the messages displayed to the Customer and the information available on the website.

4. After the Customer using the Online Shop has provided all the necessary data, an order summary will be displayed. The order summary will include information regarding:

the subject of the order,

b) the unit and total price of the ordered products or services.

c) the selected payment method,

5. To send the Order, it is necessary to accept the terms of the Regulations, provide personal data marked as mandatory, and press the „I buy and pay” button.

6. The Customer's Order constitutes a declaration of intent to conclude a sales agreement with ProAdept, in accordance with the terms of these Regulations.

7. Upon placing an Order, the Customer shall receive an email with the subject line “Thank you for your purchase from our Store” containing a final confirmation of all essential elements of the Order.

8. The agreement shall be considered concluded at the moment the Client receives the email mentioned above.

The sales agreement is concluded in Polish, and its content aligns with the Regulations.

10. ProAdept may refuse to enter into an Agreement or provide services in the event of:

a) the Customer's refusal to accept the Regulations,

b) the Client providing incomplete or false information.

5. Order fulfilment

Following payment by the customer, ProAdept will provide the necessary information required to fulfil the order via email.

a) for advertising packages/subscriptions, confirmation of launch, invoice, and, when necessary, login details or acceptance of an already registered account,

b) advertisements on the website www.indux5.com, confirmation of placing the advertisement,

c) for company verification and monitoring, an email with the company's status and an invoice.

6. Prices and payment methods

1. Service prices are given in Polish zloty and include all components, including VAT (with the rate highlighted), customs duties, and all other components.

2. The client has the option to pay for the Service:

a) by bank transfer to the Millenium bank account number:

b) using electronic payments (payment card, BLIK, Pay by Link) available on the Shop's website.

7. Termination of the agreement

1. For agreements concluded at a distance via the website “www.indux5.com”. Withdrawal from the agreement requires written notification via electronic correspondence (email):

a) The consumer has 14 calendar days to withdraw from the contract without giving a reason, with the period commencing from the day the service (advertising package, advertisement) is delivered, or from the day the contract is concluded (for services).

b) The consumer may not withdraw from the service (i.e. company checks and company monitoring) within 14 days in the event of a request to commence the provision of the service before the expiry of the 14-day period.

c) The consumer may not withdraw from the service within 14 days if the service has already been fully performed and the customer has consented (i.e. advertisement, job posting, on the Service for a period shorter than 14 days). In such a case, the customer will be informed of the loss of the right of withdrawal.

d) Reimbursement. In the event of a justified withdrawal from the contract, funds will be reimbursed promptly, but no later than within 14 calendar days from the date of receipt of the consumer's declaration of withdrawal from the contract. Reimbursement will be made using the same payment method as used by the consumer, unless the consumer expressly agrees to a different method.

8. Complaints regarding the provision of services electronicallyą

ProAdept takes action to ensure the full correct functioning of the Store, to the extent that it is possible with current technical knowledge, and undertakes to resolve any irregularities reported by Customers within a reasonable timeframe.

2. The Client is obliged to immediately inform ProAdept of any irregularities or interruptions in the functioning of the Online Shop service.

3. The Customer may report irregularities related to the functioning of the Shop in writing to the following address:

4. In the complaint, the Customer should provide their full name, correspondence address, the nature and date of the irregularity related to the functioning of the Shop.

5. ProAdept commits to processing each complaint within 14 days, or if this is not possible, to inform the Customer within this period when the complaint will be processed.

9. Final Provisions

Any disputes arising between ProAdept and the Client, who is a consumer within the meaning of Article 22(1) of the Civil Code, shall be submitted to the competent courts in accordance with the provisions of the relevant articles of the Code of Civil Procedure.

2. Any disputes arising between ProAdept and a Client who is not a consumer within the meaning of Article 22¹ of the Civil Code shall be subject to the court competent for the registered office of ProAdept.

3. In matters not regulated by these Regulations, the provisions of the Civil Code, the provisions of the Act on the provision of services by electronic means, and other relevant provisions of Polish law shall apply.

4. ProAdept reserves the right not to be liable for information provided regarding products/services by Companies advertised on the “indux5” website.
